# The College Checklist Item Most Families Forget: Essential Legal Documents for Young Adults

As you pack up the car, check off the dorm supply list, or help your child prepare for a semester studying abroad, there is one important item that is often overlooked: checking to make sure the appropriate legal documents are in place.

Once your child turns 18, they are legally recognized as an adult. A sudden and often surprising consequence of this threshold is that parents are no longer automatically entitled to access their child’s medical or financial records. Without formal legal authorization, healthcare providers and financial institutions are bound by strict privacy laws that prohibit them from sharing information with parents, even in an emergency.

Many colleges and universities now strongly recommend, or even require, that incoming students have basic legal documents in place. Planning ahead ensures that if a time-sensitive situation arises while your child is away at school, you have the legal authority to step in and help when an unexpected situation arises.

Here are the key legal documents every young adult should have before heading off to campus.

## 1. Health Care Directives & HIPAA Authorizations

If your child gets sick or sustains an injury while away at school, your instinct as a parent is to call the doctor to check on their condition and help guide their care. However, privacy regulations like the Health Insurance Portability and Accountability Act (HIPAA) prevent medical staff from disclosing health details to anyone, including parents, without written permission from the patient.

To bridge this gap, two primary healthcare documents are essential:

**Healthcare Directive**

A Healthcare Directive (also known as a Healthcare Power of Attorney) allows your young adult to designate a trusted agent, typically a parent, to make medical decisions on their behalf if they become incapacitated or physically unable to communicate their own wishes.

**HIPAA Authorization**

A standalone or integrated HIPAA Release Form gives doctors, hospitals, and medical providers explicit legal permission to share health status, diagnosis details, and treatment plans with the designated individuals.

With a Healthcare Directive and HIPAA release in place, you will not be left out of the conversation during a medical situation. You will have access to understand what is happening and the authority to ensure your child receives the best possible care.

## 2. Financial Power of Attorney

While health concerns are usually top of mind, day-to-day administrative and financial hurdles can easily pop up when a young adult is living independently for the first time. For students attending college away from home or studying abroad, having a trusted person available to handle these matters can save valuable time and prevent unnecessary complications.

A Financial Power of Attorney (POA) grants an appointed agent the authority to manage legal, financial, and property matters on a student’s behalf. Similar to the Healthcare Directive, this agent is typically a parent. These documents can be customized to cover specific situations or broad responsibilities, giving parents or other agents the ability to assist with tasks such as:

- **Managing Banking & Rent:** handling bank account issues, transferring funds, or paying rent and utility bills if your child is traveling or unable to do so.

- **Taxes & Insurance:** signing state or federal tax returns, renewing auto or health insurance policies, or handling scholarship disbursements.

- **Lease Agreements & Legal Disputes:** communicating with landlords, managing vehicle registrations, or addressing administrative issues like disputes with service providers or identity theft.

- **Study Abroad Support:** navigating financial or legal logistics back home while your child is in a different time zone or overseas.

Importantly, these documents do not take away the student’s independence. Instead, they provide a practical safety net by allowing the student to choose who may assist them if the need ever arises.

## Prepare Your Family Before Moving Day (and After is Okay Too)

For many families, estate planning is not something they associate with an 18-year-old. However, these documents are less about planning for the unexpected worst-case scenario and more about ensuring that parents and other trusted individuals are able to support their child when needed.

Our team specializes in making estate planning straightforward and efficient. With a brief appointment before your student leaves for school (and after still works too), we can draft and execute the necessary Healthcare Directives, HIPAA releases, and Financial Powers of Attorney, giving your family peace of mind as your child takes their next big step into adulthood.  Please reach out to [David Ness](https://www.fmjlaw.com/professional/david-m-ness/), [Alayna Bell](https://www.fmjlaw.com/professional/alayna-bell/), or the rest of our [Trusts & Estates Team](https://www.fmjlaw.com/practice-area/trusts-estates/) soon.
