# Legislative Update: More Minnesota Employment Law Changes Might be on the Horizon

The 2023 Minnesota legislature passed a record number of new employment laws, including paid sick leave, a ban on non-competes, and legalized cannabis, among others. While Minnesota employers are still working to understand, implement, and respond to these new requirements, the Legislature is back in session and busy debating even more changes. Some of these discussions include proposed amendments to the laws passed last year.

Here is a list of what the Legislature is considering so far in 2024:

- **Non-Competes:** “Shadow” non-compete clauses would be banned under HF3456 sponsored by Rep. Emma Greenman. The law would prevent a company that provides services to a customer from restricting the customer from directly or indirectly soliciting or hiring one of its employees.  The proposal has met with some criticism.

- **Paid Sick and Safe Time:** Another bill, HF3882, would amend the paid sick and safe time law. Proposed amendments include removing the exception for airline flight crews. Other tweaks being discussed include: (A) adding attendance at a family member’s funeral and addressing legal or financial matters related to the death of a family member as a basis for paid leave; (B) authorizing the Department of Labor and Industry to make rules and enforce the law; (C) making employers liable to each employee who does not receive or is not allowed to use earned time off, and setting damages; and (D) allowing an employer to choose a reasonable system to report the use and availability of hours that are available to employees.

- **Salary Range Disclosure:** A bill sponsored by Rep. Kristin Bahner would require employers with more than 30 employees to disclose salary ranges, benefits, and compensation in job postings.

- **Misclassification: **Another bill, HF4444 would empower the Department of Labor and Industry to penalize a business up to $10,000 if it classifies, represents, treats, reports, discloses, documents, or enters into an agreement with an employee that treats the employee as something other than an employee – such as an independent contractor.

- **Drug Testing:** HF3516 would amend the Minnesota Drug and Alcohol Testing in the Workplace Act to allow drug testing using saliva.

- **Personnel Files:** The Legislature is discussing an amendment to Minn. Stat. Section 181.960, which requires employers with 20 or more employees to provide copies of personnel records upon request. The bill would make the law applicable to employers of any size.

It is possible that none of these bills will be enacted into law, and they could be changed significantly along the way. Unfortunately, few employer-friendly changes are on the table that would make compliance with recent laws easier or clearer. So, employers should be prepared for more legal requirements coming from the Minnesota Legislature in 2024.
