Seven FMJ attorneys were recently selected Super Lawyers by Twin Cities Business and Minnesota Super Lawyers Magazine. This is an honor given to only 5% of the lawyers in Minnesota. David Runck Argues Before U.S. Court of Appeals On Behalf of Petters' Unsecured Creditors(+)

On June 17, 2010, David Runck argued before the U.S. Court of Appeals for the Eighth Circuit in the case of Ritchie Special Credit Investments, Ltd., et al. v. U.S. Trustee and Official Committee of Unsecured Creditors, Case No. 09-3271. The appeal arises from the Chapter 11 bankruptcy cases of Petters Company, Inc. and Petters Group Worldwide, LLC in which FMJ is lead counsel for the Official Committee of Unsecured Creditors. In the appeal, and in the bankruptcy cases, the Committee represents the interests of unsecured creditors who are owed more than $3 billion, caused by a massive Ponzi scheme orchestrated by Thomas J. Petters.

Don Mark, Jr. Secures $1.25 Million Dollar Winning Verdict in the Jimmy Williams Case(+)

Don Mark, Jr., one of the founding shareholders of FMJ, has secured a $1.25 million dollar verdict in the Jimmy Williams case versus the University of Minnesota and head basketball coach Tubby Smith. Mr. Williams contended that Mr. Smith had offered him a job as assistant coach for the men’s basketball team in April of 2007, but that the job didn’t materialize after University of Minnesota Athletic Director Joel Maturi vetoed his hire based on past NCAA violations. Mr. Williams quit his job as Assistant Basketball Coach at Oklahoma State and put his house on the market based on Mr. Smith’s offer and has been unable to find employment since.

FMJ Represents Scandinavian Airlines System (SAS) in Sale of 18 Planes to Allegiant Travel Co.(+)

SAS and Allegiant Travel Company announced on January 4th, 2010 that the parties reached an agreement involving the sale of 18 MD-80 aircraft by Scandinavian Airlines System to Allegiant Travel Company. FMJ attorneys Robert Fafinski, Jr., James Gladen, Tara Anderson and Heather Halverson represented SAS in the transaction. SAS is one of Europe's largest airlines and FMJ has served as its U.S. Counsel for many years.

FMJ staff and attorneys are collecting backpacks and school supplies to donate to at risk and low income children. The firm is making a contribution as well. Check FMJ's progress throughout the year on the "10 Acts of Kindness" page under "Our Firm" on the website.

Greg Brenny and Marissa Ulstad were an integral part in the purchase by PROP (People Reaching Out to Other People) of a new and larger facility. Greg and Marissa donated their time and expertise in commercial real estate to assist PROP on a pro bono basis.
PROP is a nonprofit emergency food shelf serving the Eden Prairie and Chanhassen communities. PROP has seen a marked increase in needs for services and the old building, at less than 3,000 feet, was not adequate to meet their needs to help the community. FMJ has also assisted PROP through annual food drives over the last several years. FMJ is committed to use its expertise in giving back to the community).

FMJ Assists Basketball Coach Jimmy Williams in Gaining Reinstatement of His Lawsuit Against the University of Minnesota and Athletic Director Joel Maturi (+)

FMJ assisted basketball coach Jimmy Williams in gaining reinstatement of part of his lawsuit against the University of Minnesota and Joel Maturi, the University's athletic director. On March 31, 2008, the Minnesota Court of Appeals reversed the Hennepin County District Court's dismissal of Williams' claim for negligent misrepresentation, and remanded the case to the district court for further proceedings. Williams' claim arises from conversations he had with Minnesota men's basketball coach Tubby Smith in April 2006.
FMJ serves as Williams' co-counsel, along with attorney Richard Hunegs of Hunegs Stone LeNaeve Kvas & Thurnton, P.A. As co-counsel, FMJ drafted Williams' appellate brief and argued his appeal before the Court of Appeals. The Court of Appeals' opinion is Williams v. Board of Regents of University of Minnesota, 763 N.W.2d 646, 2008 WL 5772256 (Minn. Ct. App. March 31, 2009).

Typically, a client will choose between one of five entities: sole proprietorship, general partnership, limited liability partnership, corporation (C-Corp and S-Corp) and a limited liability company. This program will highlight the basics of each entity by focusing on entity formation, income taxes, liability protection, and general distinctions between entities.

A day to support a good cause turned out to be very memorable for FMJ partner, Greg Brenny. Greg hit a hole-in-one while supporting the Ronald McDonald House at a charity golf event sponsored by Shingobee Builders www.shingobee.com/ at Burl Oaks Golf Club recently. The shot was hit with a 7 wood on a 199 yard par 3. Congratulations Greg!

MSBA Certifies Greg Brenny as a Board Certified Real Property Specialist (+)

FMJ congratulates Greg Brenny on recently being certified by the Minnesota State Bar Association as a Board Certified Real Property Specialist. Less than 20% of the attorneys that belong to the MSBA Real Property Law Section are certified.
To earn certification, Greg had to pass a comprehensive 3.5 hour exam and demonstrate extensive knowledge and experience in the area of real property law. Thomas Wolf of the Minnesota State Board of Legal Certification states, "If a lawyer is certified as a real property specialist, a buyer of legal services should be able to rely on the fact that the lawyer has survived a rigorous application and approval process aimed at identifying the skills and knowledge that real property specialists should have."

The Executive Council of the Minnesota State Bar Association Business Law Section met on May 21, 2008, and elected FMJ's Pat Shriver as Chair for the period of July 1, 2008 through June 30, 2009.
The MSBA Business Law Section drafts, proposes, and reviews legislation such as improvements to the Minnesota Business Corporation Act, Uniform Partnership Act, Limited Liability Company Act, Uniform Commercial Code, and Non-profit Corporation Act. The section publishes a quarterly newsletter, conducts an annual Business Law Institute, presents noontime programs, and produces pamphlets on business entities and UCC filings.

Robert R. Fafinski, Jr. has been named to the Executive Board of Directors of Common Hope, a nonprofit organization based in St. Paul that aids Guatemalan children and their families. Common Hope doesn't just support the child, but believes in forming a partnership with the entire family to assist them in achieving their goals and improving their lives. Bob and his family are involved in numerous charitable organizations supporting education and the development of children. They became involved with Common Hope when they traveled to Guatemala as volunteers with the organization in 2006. They have been active sponsors since that time.

The Court ruled from the bench in MAC's favor granting MAC summary judgment and ordering the immediate payment of over $3.1 million by the Liquidating Trustee for Mesaba Airlines to MAC. FMJ's Bankruptcy and Insolvency Group represents lenders and financial institutions in bankruptcies and default situations in matters across the country.

Runck, who recently joined FMJ's Bankruptcy & Insolvency group in August 2007, will be one of the speakers on the subject of "Defaults, Workouts and Bankruptcy Issues in Public Finance" at the upcoming National Association of Bond Lawyers 32nd Annual Bond Attorneys' Workshop to be held on September 26-28, 2007 at the Sheraton Chicago Hotel & Towers, Chicago, Illinois. In his presentation, Mr. Runck will discuss some of the unique issues faced by indenture trustees and bondholders when projects financed with tax-exempt municipal bonds (such as hospitals, senior living facilities, multifamily housing projects and industrial development projects) go into default. Mr. Runck specializes in representing financial institutions involved in distressed loan transactions. He represents banks and other lenders in bankruptcy cases, real estate foreclosures, receiverships, loan workout negotiations, and in civil litigation matters pending in state and federal courts. David has extensive experience representing banks, secured and unsecured lenders, equipment finance and leasing companies, indenture trustees and bondholders, and real estate lessors.

Patrick J. Rooney has joined FMJ's litigation practice group in the capacity of Counsel. Pat, previously a partner in the litigation department of a large Minneapolis law firm, will maintain his practice in the areas of commercial, employment, insurance defense, and products liability litigation, and will also continue the expansion of his practice within the commercial aviation industry.
Since 2001, Pat has served on the board for The Fund for the Legal Aid Society, an organization whose primary task is to raise money to support The Legal Aid Society of Minneapolis. Pat has been named a top lawyer in Minnesota in the area of business litigation, and has been selected by his peers as a Super Lawyer® every year for the past seven years through Minnesota Law & Politics - a distinction received by less than 6% of the lawyers in Minnesota.

More recently, the Foundation has branched into causes where aviation assets are utilized to deliver humanitarian aid, most recently in connection with Hurricane Katrina.

He was also responsible for purchase agreements for up to 430 regional jet aircraft with an aggregate cost of over $4 billion and related financing commitments for up to 170 firm orders.

At the age of 44, Anderson is the NFL's all-time leading scorer and over the past 22 years has played with the Steelers, Eagles, 49ers, Vikings and Titans. Anderson has recently announced his retirement. Mark has been a Certified Contract Advisor for the National Football League Players Association since 2001 and has been a friend and advisor of Gary Anderson since 1999.
